Law against Love Jihad to be implemented nationwide

  • Without mentioning Love Jihad, the law states that ‘marrying a woman by concealing identity shall be an offence’
  • Punishment of minimum 10 years

New Delhi – Union Home Minister Amit Shah informed in the Lok Sabha on 11th August that the British-era laws will be repealed and replaced with ones which will not punish the people, rather will give justice. Accordingly, Shah has also suggested that very strict laws be made regarding crimes against minors and women. Shah also said that a man guilty of marrying a woman by concealing his identity i.e. religion will be severely punished.

Currently, Love Jihad is rampant across the country. It is being said that this law will help curb Love Jihad. In this law, there will be a provision of punishment for marrying a woman by concealing identity under false promise of employment or promotion.

At present, establishing sexual relations with a woman on the pretext of marriage is not considered rape but the new law will have provision for this. It will be punishable with minimum 10 years imprisonment and fine.

The ‘Indian Penal Code,1860’ will be replaced by ‘Bharatiya Nyaya Sanhita 2023’ Bill, which will include laws related to crimes against women.

Duration of punishment for crimes against women

Rape : At least 10 years of jail to life imprisonment for the rapist.

Gang rape : At least 20 years imprisonment in case of gang rape.

Death of a woman after rape : If the woman dies after the rape or remains in persistent vegetative state, the accused can be punished with imprisonment from 20 years to life imprisonment or even death penalty.

Rape of a girl under 12 years : The above rule will also apply if a girl under 12 years of age is raped.
