Why reservation cannot be applied to  poor students born in high caste ? : Supreme Court

New Delhi – A hearing on the petition filed against the system of reservation not covering poor students born in high caste is going on in the Supreme Court. Why reservation cannot be applied in the case of poor students born in high caste ? was asked by a Judge to the advocate of the petitioners. On that the petitioners stated that 103rd Constitutional Amendment was contrary to the Constitution. They pleaded that reservation cannot be based on financial conditions. Upon which the Supreme Court argued saying that, large population in the country is below the poverty line and they are deprived of good education due to their poverty. Hence why cannot they be given the right to reservation on the basis of poverty ? The Supreme Court asked the advocate of the petitioner.

Division Bench of Chief Justice Uday Lalit, Justice Dinesh Maheshwari, Justice S Ravindra Bhat, Justice Bela Trivedi and Justice P Pardiwala asked the question then, why cannot the poor students be included in social class ?
