Do not allow polygamy among Muslim men : PIL in Delhi High Court

New Delhi : A 28-year-old Muslim lady named Reshma has filed a Public Interest Litigation (PIL) asking denial of permission to Muslim men to marry twice or entertain polygamy unless the permission is granted by the first wife. The Court has sent a notice to the Centre asking for its response. The said hearing will be held on 23rd August.

The PIL states,

  1. From a woman’s viewpoint, this is a retrograding and insulting system. Polygamy is against the Constitution, illegal and the Shariat. Polygamy has been allowed in Shariat in exceptional conditions.
  2. The issue concerning Muslim women needs to be controlled through law. In case a Muslim man wants to remarry then he has to get written permission from his previous wife and a written certificate sanction from a Govt officer. He should be able to take responsibility for all the wives. Before remarrying, the Muslim man should declare his previous marriages. A law should be passed to make the registration of marriages of Muslims compulsory.
