Acquiring anyone’s private property without compensation is against Human Rights : Supreme Court

New Delhi – The Supreme Court has directed the Himachal Pradesh Government to compensate the petitioner for the land acquired 49 years ago for road construction. The Supreme Court ruled that there can be no time limit for judgment and dismissed the Government’s years-long argument. The acquisition of private property without compensation is a violation of Human Rights and the rights under Article 300A of the Constitution ruled the Supreme Court.
Justice S Ravindra Bhat and Justice P S Narasimha’s Bench passed the order on the plea of petitioner Sukh Dutt Ratra. The Supreme Court also ordered the Himachal Pradesh Government to pay the petitioner an additional Rs 50,000 as expenses incurred for fighting the Supreme Court case. The land of petitioners Sukh Dutt Ratra and Bhagat Ram was in Pachhad Taluka of Sirmaur District in Himachal Pradesh. The State Government had acquired their land in the year 1972-73 to build a road there, but they were not compensated.
