Supreme Court rejects plea seeking Constitution of India instead of ‘Hindutva’
New Delhi – A petition demanding the use of the word Indian Constitution instead of the word ‘Hindutva’ was filed by Dr S.N., a resident of Vikaspuri in Delhi. Kundra had entered PIL in the Supreme Court. This petition was rejected by the court. ” This is a complete abuse of process,” the court observed. In 1995, the Supreme Court, while deciding a case regarding a speech made by Shiv Sena founder Balasaheb Thackeray, defined Hindutva as a way of life. The words Hinduism or Hindutva are not to be understood. It is not possible to give a brief interpretation of Hindutva. It is not limited to religious practices related to the culture and ethos of the people of India. The Supreme Court also said that it depicts the lifestyle of the Indian people.
A petition was filed in the Supreme Court seeking a review of the 1995 judgement. Even at that time the court refused to consider this petition.
