The administration’s action of demolishing the mosque at Gir Somnath justified : Gujarat HC

Ahmedabad (Gujarat) – On September 28, the local administration had demolished several illegal structures like mosques, dargahs, tombs etc. standing on the Government land at Gir Somnath. This is said to be the biggest action against illegal constructions at national level. A petition was filed against this action in the Gujarat High Court seeking restoration of the condition before the demolition of these structures. The Court dismissed the petition on 3rdNovember and refused to maintain status quo.

1. The petition was filed by the ‘Auliya-E-Din Committee’, a Waqf organisation.

2. The Court, holding that the action taken by the State Government was justified, issued a notice to it, demanding information about the action and also directed the petitioner’s association to provide information.

3. A single bench of Justice Sangeeta K. Vishen further made it clear that there was no such direction given by any Court or administrative officer that such action should not be taken legally. Therefore, the action taken by the Government is not illegal.

* What is the matter ?

On September 27, more than 35 bulldozers had taken action against more than 50 illegal mosques, dargahs, tombs, houses of mujawar (servants in the dargah) spanning over 102-acre area. Like the Mahakal Corridor at Ujjain, a corridor will also be set up at Somnath. Despite administration issuing notices to this illegal construction, they were not removed; finally, administration itself took action. During the action, Muslims had gathered in large numbers. Around 1,400 Police personnel were deployed to control the situation.

Editorial Perspective

Since the administrations of different States have started taking appropriate action without fear of Muslims, the Muslim organisations are agitated. Through such petitions, this is a cunning attempt by religious fanatic Muslims to create confusion in the Courts. It will not be wrong to call it ‘Petition Jihad’.
